BJP leader Shahnawaz Hussain is getting strong setbacks one after the other from the Supreme Court. The Supreme Court on Thursday refused to stay the Delhi High Court's order to file a case against Shahnawaz Hussain on a complaint by a woman who accused him of rape Have given. The Supreme Court has also decided to list Hussain's appeal against the High Court's decision next week.
The Delhi High Court has ordered registration of an FIR against Hussain on the complaint of a woman. The court ruled that there was no error in the lower court's 2018 order directing registration of the FIR. Also, the High Court had nullified its interim orders staying its implementation.
BJP leader's counsel Mohit Paul told a bench headed by Chief Justice NV Ramana, "Now if an FIR is lodged, my SLP (Special Leave Petition) will become infructuous." I have 30 years of unblemished public life and it will be tarnished. However, a bench headed by CJI has ordered to list the petition next week.
The High Court in its order had said, “The present petition is not maintainable. The petition is dismissed. The interim order shall be deemed ineffective. FIR should be lodged immediately. The inquiry should be completed and the detailed report under section 173 of CrPC (Code of Criminal Procedure) be submitted before the Metropolitan Magistrate within three months.
